Terms of Service

These Terms of Service ("Terms") govern your use of bigsteele.com, our customer portal, and any services offered by Big Steele Music LLC ("Big Steele," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you don't agree, please don't use the Site.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site or purchase services.

2. Accounts

Some features (e.g., the customer portal at /portal) require an account. You agree to provide accurate information and to keep your credentials confidential. You're responsible for activity that occurs under your account.

3. Services

We offer consulting, automation implementation, AI strategy work, speaking engagements, training (e.g., Bootcamp), and digital subscriptions. The specific scope, deliverables, and timelines for any engagement will be set out in a separate proposal, statement of work, or product description at the time of purchase.

4. Payment and Billing

  • Fees are billed in advance unless we agree otherwise in writing.
  • Subscriptions automatically renew until cancelled.
  • Payments are processed by Stripe. By providing payment information, you authorize Stripe to charge your payment method.
  • Except as required by law or expressly stated in a product description, all payments are non-refundable.

5. Acceptable Use

You agree not to:

  • Use the Site to violate any law or third-party right.
  • Attempt to interfere with, gain unauthorized access to, or disrupt the Site or its underlying systems.
  • Scrape, reverse-engineer, or extract data from the Site outside of documented APIs or features.
  • Misrepresent your identity or affiliation.

6. Content and Intellectual Property

  • The Site and its content (text, graphics, code, videos, blog posts, course materials, and any deliverables) are owned by Big Steele Music LLC or our licensors and are protected by intellectual property laws.
  • Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal or internal business purposes.
  • Any content you submit (form responses, account profile data, etc.) remains yours, but you grant us a license to use, store, and process it as needed to provide services.

7. Third-Party Services

The Site integrates with or links to third-party services (Supabase, Stripe, Resend, GoHighLevel, Cloudflare, Vercel, Meta, OpenAI, etc.). We're not responsible for the practices of those third parties. Your use of those services is subject to their respective terms.

8. Disclaimers

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Nothing on the Site constitutes legal, tax, financial, or professional advice.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIG STEELE MUSIC LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS, ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

10. Indemnification

You agree to defend, indemnify, and hold harmless Big Steele Music LLC and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any third-party right.

11. Termination

We may suspend or terminate your access to the Site or services at any time, with or without cause or notice. Provisions intended to survive (including sections 6, 8, 9, 10, and 12) will survive termination.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law provisions. Any disputes will be resolved in the state or federal courts located in Orange County, Florida, and you consent to personal jurisdiction there.

12A. SMS Messaging Terms

Program Name: Big Steele Music LLC Customer Care SMS Program

By submitting a form on our website and opting in to receive text messages, you agree to receive non-marketing customer care and service-related SMS/text messages from Big Steele Music LLC.

These messages may include customer care replies, follow-up messages related to your inquiry, booking or scheduling follow-ups, appointment reminders, event-related support, service updates, account notifications, order confirmations, and communications related to services you requested.

Message frequency may vary. Message and data rates may apply depending on your mobile carrier and plan.

You may opt out of receiving SMS messages at any time by replying STOP. After replying STOP, you may receive a confirmation message, and you will no longer receive SMS messages from Big Steele Music LLC unless you opt in again.

Mobile carriers are not liable for delayed or undelivered messages.

SMS messaging services are intended for users who are at least 18 years old. By opting in to receive SMS messages, you confirm that you are at least 18 years old or have permission from a parent or legal guardian.

13. Changes
